Terms and Conditions of Service

1. Description of Service

Invigismart Pro™ provides an automated, web-based exam invigilation scheduling and roster management platform designed for primary, secondary, and tertiary educational institutions.

2. Subscription Terms & Billing

• Annual SaaS License: Invigismart Pro™ is billed on an annual subscription basis. Each license grants full, unlimited access to the platform for 12 calendar months (365 days) starting from the date of payment or account activation — covering every exam season, sitting and roster the school generates during that period.
• Payment Processing: All online payments and subscription renewals are securely processed through PayFast (Pty) Ltd, our authorized payment gateway.
• Pricing & Currency: All prices listed on our website are in South African Rand (ZAR) unless explicitly stated otherwise. We reserve the right to adjust annual subscription pricing prior to any renewal period with 30 days’ advance notice.

3. Refund & Cancellation Policy

(PayFast requires a clear refund policy to process payments.)

• Cancellations: You may cancel your annual subscription at any time prior to your next renewal date through your account dashboard or by contacting support. Cancellation stops the automated renewal at the end of the current 12-month cycle.
• Refund Policy: Because Invigismart Pro™ offers instant digital access and evaluation tools, subscription fees paid for an active 12-month cycle are non-refundable once the account has been activated and used to generate rosters, except where required by the South African Consumer Protection Act (CPA) or in the event of an unresolvable technical service disruption caused directly by us.
• Trial & Evaluation: Free trials are provided strictly as a time-limited evaluation of the platform — long enough to build and run a full roster for a single exam sitting — so that a school can decide whether to buy the annual licence that covers its whole exam year. Everything a free trial produces (the on-screen duty sheet and any CSV export) is marked as an evaluation copy and is not a clean, final invigilation document. Clean, unmarked duty sheets and exports, including the server-rendered export, require an active annual subscription. Using free trials in place of a paid licence for live examination periods (for example, repeatedly registering new accounts to avoid the annual fee) is not a permitted use of the service.

4. User Accounts & Responsibilities

• You are responsible for maintaining the confidentiality of your administrator login credentials.
• You warrant that you have the lawful authority on behalf of your educational institution to upload administrative data (such as staff lists, subjects, and timetables).
• You agree not to reverse-engineer, decompile, copy, or resell the Invigismart Pro™ platform, constraint solver algorithms, or branding assets.

5. Intellectual Property

All software, algorithms, code, interface designs, trademarks, logos, and documentation related to Invigismart Pro™ are the exclusive intellectual property of Prinsloo Consulting. Your subscription grants you a non-exclusive, non-transferable, revocable license to use the software for your internal school administrative operations during your active subscription term.

6. Service Availability & Support

We strive to maintain a 99.9% portal uptime. Scheduled maintenance will be communicated in advance. Technical support is provided via email at daniel@invigismart.online during standard business hours (Monday – Friday, 08:00 to 17:00 SAST).

7. Limitation of Liability

To the maximum extent permitted by South African law, Prinsloo Consulting shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, including data loss or administrative disruptions during school exam periods.

8. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the South African courts.
